The fish has to be confiscated as it would be evidence if the ticket was brought to court, I know it sounds dumb and maybe unfair but that is how it has to be done. CO's like Police have certain procedures they have to follow when they make a charge, the fish is put in a freezer back at the office and can't be thrown out until the matter is resolved.

Sorry for the loss of your fish and the fine, but the M.N.R is paid to enforce the regulations. What good would they be if they looked the other way whenever they spotted someone breaking the law?

Fish4Dinner, I agree everyone can rant after running into the lawman. The problem I have is this line "Guy was rude and got loud when I said he could tell the difference" Put another way as, I gave the cop attitude then complained he was mean to me.

So, you take anything they dish your way? Just keep your mouth shut? You have a bag of oregano, cop tells you it's weed, you say "you are correct officer"? Oh wait, I forgot, you keep your mouth shut.

That is a horrible rule to advise people. In the eyes of the law silence is acceptance 9 out of 10 times.
Recently I was pulled over at the corner of Dundas and Keele turning right and the light. For those that know that area. You cannot turn right on the red. I proceeded to turn when it was yellow. I was driving a slow turning vehicle and when I completed the turn the lights changed. The office pulled me over saying I turn on "Red" and advised me I am recorded and video. Right away I voiced my side of the story and said the light was not red when I turned. He said nothing and went back to his car and wrote me a warning and not a ticket as he said I was 1 for 1 on my answer. He then asked if I was insured with the vehicle as my name was not on the insurance slip. I said it is a company vehicle and yes I am insured. He said I am 2 for 2 and have a good day.
I still voiced my displeasure as I got a warning even after he admitted I was 1 of 1 on my claim I did not turn on the red. If he believed enough that I did not turn on a red to issue me a ticket... why still the warning? The warning still implies I turn on red. Makes sense?

Disagreeing with law enforcement is completely fine, we've all been there. How a person voices their concern is another matter altogether. If you're respectful and polite, then most officers will be too. If you're being an a##, then they're going make your bad day even worse. I drive a truck for a living, and being an outdoors person too, I deal with nearly every enforcement agency in Ontario, from the MNR to the MTO, OPP, even the Environmental Enforcement folks. I have learned in my time that politeness and courtesy go a hell of a long way in resolving things. I'm 99% certain that I've been given warnings instead of tickets, simply because I wasn't a prick...

If a cop said my oregano was weed I would 100% be keeping my mouth shut. In court the officer would look like an idiot and I would walk.

If you are 100% in the wrong I agree you keep your mouth shut as nothing that will come out of your mouth that can help you. If you are not wrong you speak up! Never bend over and take it if you are not wrong. I think we all can agree to that?
