i called the mnr today and they said live herring can be used as bait on simcoe,they are listed as a baitfish not a gamefish....and there are no exceptions.i hope this clears all the confusion up

Maybe.
But no matter what, obviously you can NOT use (at least you can NOT use more than 2) herring that you caught from Lake Simcoe, per 2017 Ontario Recreational Fishing Regulations Summary Page 81:

Simply put, by law I don't believe one can catch a herring from Lake Simcoe, and then immediately put this herring on a hook as bait on the same lake (Lake Simcoe)

Per the currently MNR fishing regulations, herrings/cisco is open Jan 1 to March 15, and then 2nd Saturday in May to Sept 30, and your daily catch (and keep) limit (and possession limit) is 1 if you have a conservation licence, or 2 if you have a sport license.
Hence herring/cisco from Lake Simcoe is game fish --> herring/cisco from Lake Simcoe is NOT baitfish
Hence herring/cisco from Lake Simcoe can NOT be used as bait fish.

just called the branch director of mnr,,,,it is 100% legal to use a herring caught from lake simcoe as bait in lake simcoe.
if you had a sportman license you can use 2 a day,conservation,just one,,,,you have to take the herring home with you if not eaten by a gamefish because its against the law to waste fish
