Man what a topic. What one officer says may vary from what another one says. Clearly says you can not use a sport fish for bait so if it's in the regulations as a sport fish then you shouldn't be able to use it. Then you get a conservation officer tell you that you can. I am bringing my lawyer fishing with me from now on..

I have spoken with the MNR previously on this issue and went through several avenues to get a clear answer. You MAY use herring as bait on Simcoe, however, you MAY NOT exceed your possession limit. No more than 1 (conservation) or 2 (sport) daily. That means if you go through 2 and have no more bait, you are SOL.

To add to this, if you are bringing frozen herring to the lake, you'd better bring a receipt.

this is an example where the regulations in the book says one thing and have exceptions. Simcoe has a limit on herrings therefore classifying it as a sport fish but can be caught and used as bait. But if you were to catch a goby and cut its head off and use it you will be fine!
I personally do not care who is right or wrong and who anyone called. Unless it is printed in words and I hold a hard copy of that I will do what I know in the regulations. Have MNR respond by email and send it to you. People have been burnt when going by words. Person you spoke to may not be the person you deal with on the lake. Not all MNR officer are alike. James is going by the printed regulation of what is a game fish.
I deal with people all day long making promises and guarantees. Unless it is in writing it means absolutely nothing to me! In court saying "someone over the phone told me" does not stand as fact!

Thank you! Again exactly what I meant.
1. Simcoe herring is defined as game fish, and there are an open season and catch/possession limit on it.
2. I can not use game fish from Simcoe as bait fish on Simcoe.
3. From the MNR's fishing regulations I myself did NOT find in print "Simcoe's game fish herring can also be used as bait fish on Simcoe" and finally
4. One particular or any MNR CO/officer said means ABSOLUTELY nothing at all. What counts is what the regulation and/or a judge in a court says. Not what this or that MNR CO/officer said;-)
I think I have expressed myself clearly (I hope), and I am done on this one.

the only reason for the limit is because of the previous ban,they have to be limited.....i think this is where the confusion between baitfish or gamefish comes from,but they are classified as a baitfish
